Can I bring a pet? – the answer is generally “NO”.
The majority of our managed vacation homes are governed by Homeowners Associations and HOA Boards separate from, and not under the control of Vail Realty. Most of these Associations have rules and regulations that do not allow renters to have pets of any kind, including emotional support animals. If a guest is traveling with a bona fide Service Animal, guest will notify Reservations in advance so that a reasonable accommodation may be provided. Failure to notify Vail Realty prior to arrival of any Service Animal may result in the unilateral relocation of the guest to alternative accommodation at the guest’s expense. If there is evidence of pets or non-ADA qualified animals in the property without prior approval, guest will be liable for the greater of: (a) the cost of a full deep cleaning of the property (including all upholstery and carpeting); or (b) $500 fine per day. Guest may also be evicted without refund.
SERVICE ANIMAL vs. EMOTIONAL SUPPORT ANIMAL DEFINITION
Under the ADA, a Service Animal is defined as a dog that has been individually trained to do work or perform tasks for an individual with a disability. The work or tasks performed by a Service Animal must be directly related to the individual’s disability. The dog must be trained to take a specific action when needed to assist the person with a disability.
Emotional Support Animals (ESA) that provide therapy, comfort, well-being, or companionship by being with the person DO NOT QUALIFY as Service Animals under the ADA because they have not been trained to perform a specific job or task and are explicitly not permitted in most properties, even if your dog is registered as an Emotional Support Animal. If your dog is not a Service Animal as defined by the ADA, you will need to board it.
To determine if an animal is a Service Animal, you will need to answer the following questions:
1. Is this animal required because of a disability? YES/NO
2. What work or task has this animal been trained to perform?
Please note that if your dog meets the ADA definition of a Service Animal, it cannot be left in a room unattended. Service Animals must be under the handler’s control at all times.
